Canopy Privacy Policy

This Privacy Policy describes how SNTNL LLC and its affiliates ("Canopy," “Company”, "we", “our” and "us") collects, uses, protects, stores, discloses, and otherwise processes information when you visit our Sites, use our Apps, or purchase or use one of our Products or other Services.  Capitalized terms used but not otherwise defined herein shall have the meanings ascribed in the Terms of Service. 

 

By using the Services, you are consenting to this Privacy Policy. Please read it carefully and retain a copy for your records. If you have any questions, requests, or concerns regarding the processing of your personal information, please contact privacy@canopy.security.

  1. Categories of Personal Information We Collect
    Canopy collects the following categories of personal information, for one or more of the Business Purposes as further described in Section 2 of this Privacy Policy below:

  • Contact information: Where you have provided it, we may collect your full name, email address, billing address, shipping address, and telephone number.

  • Identifiers: We may collect, where you have provided it, your driver’s license number and issuing state, vehicle license plate number and vehicle license plate state, vehicle insurance number, vehicle identification number (VIN), as well as your username and password, and your computer’s IP address.

  • Financial Information: Where you are providing payment details to us, we will collect your payment card number, payment card expiration date, and CVV code.

  • Usage information: When you interact with any of our websites or applications, we will collect information related to such interactions, including browsing history, device types, operating system, browser settings, IP address, language settings, and information on how you use our website and application.

 

  • Commercial information: We will collect records of products or services purchased, obtained, or considered, and your purchasing history with us.

  • Geolocation information: If you use the Canopy Product, we will collect precise location information from the Product and any device which is using the App. We may also collect imprecise location information based upon your IP address when you access the Services.

  • Applicant Information: If you apply for a job with Canopy via our Site or Apps, we will collect information about you, your prior education and work history and your skills and qualifications for the position. We may ask about your salary expectations and how you learned of the position. We may also ask you for contact information so that we can check references.

  • Audio/Visual Information: If you use the Canopy Product, we will collect audio, electronic, photographic, visual or similar information collected by the Product. This includes images, videos, audio, and radar data collected by the Product in the vicinity of a vehicle which is using the Product.

  • Inferences: We may use information described in the categories above, including audio/visual information and geolocation information, to create a profile of your behavior, including the use of artificial intelligence and machine learning to determine and predict activity levels around your vehicle.

  1. Business Purposes for Collecting Personal Information
    We use your personal information as described below. We do not sell your personal data.  Below is a list of the purposes for using each category of information:

  • Transactional Purposes:  We will use your contact information, identifiers, financial information, usage information, geolocation information, audio/visual information, and inferences to:

    • Qualify and enroll you for the products and services.
    • Provide you with the products and services.
    • Fulfill your order requirements.
    • Process payments.
    • Send confirmations and shipping or transit information.
    • Communicate with you.
    • Respond to customer service requests and inquiries.
    • Administer your online account with Canopy.

  • Employment Purposes: We will use your contact information, and applicant information when you apply for a job with Canopy via our Site or Apps.

  • Analytical Purposes: We may use your identifiers, usage data, commercial information, geolocation data, audio/visual information, and inferences to analyze preferences, trends, and statistics.

  • Marketing and Promotional Purposes: We may use your contact information, identifiers, commercial information, usage information and geolocation information to provide you information about us and our products, including personalized marketing communications. You can choose to opt-out of marketing communication, as per Section 9 of this Canopy Privacy Policy.

  • Maintenance and Improvement of the Services: We may use your contact information, identifiers, commercial information, usage information, geolocation information, audio/visual information, and inferences to improve the Services, provide and maintain functionality of the Services, and help us diagnose technical and service problems and administer the Services.

  • Develop and Improve our Products and Services: We may use your contact information, financial information, identifiers, commercial information, usage information, geolocation information, applicant information, audio/visual information, and inferences to help us develop new products and services and to improve and analyze our existing products and services. This includes training the threat detection platform to accurately identify security events, and to assess the effectiveness, quality, and functioning of the Services.

  • Security and Fraud Prevention: We use your contact information, identifiers, financial information, commercial information, usage information, geolocation information, applicant information, audio/visual information, and inferences to protect the Services, to protect us, our affiliated companies, our employees, and others; and to prevent fraud, theft, and misconduct.

  • Legal: We may use your contact information, identifiers, financial information, commercial information, usage information, geolocation information, applicant information, audio/visual information, and inferences to comply with our legal obligations, including reporting requirements, to defend ourselves in legal proceedings, and protect our Company, our property, employees, and others through legal proceedings.

  • Other Purposes: We may use contact information, identifiers, financial information, commercial information, usage information, geolocation information, applicant information, audio/visual information, and inferences for other reasons which we will notify you of in advance.

  1. Methods of Collecting Personal Information
    We collect personal information in the following ways:

  • Directly from you: We will collect contact information, identifiers, and financial information that you have provided directly to us, including via the Services.

  • Automatically: When you access or use the Services, we will collect identifiers, geolocation information, usage data, and audio/visual information from the Product, the App, Site, or using tools like browser cookies.

  • From third parties: We may collect contact information and publicly available identifiers from third parties, including social media platforms or networks, service providers, and public authorities.

  1. We Combine Information
    We may combine information we obtain from different sources with publicly available information. For example, we may combine information that we have collected from online and offline sources, or from other third-party sites. We combine information across devices, such as computers, mobile devices, and cloud services.

  2. How We Share Information with Others
    We will share personal information in the following circumstances or as otherwise described within this Privacy Policy:

  • Service Providers: We may share necessary personal information with vendors and service providers who support the operation of the Services and our business, and who need access to such information to carry out their work for us (including, for example, web hosting, analytics, email delivery, marketing, insurance, shipping, and customer support services). In some cases, the vendor or service provider may directly collect the information from you on our behalf, as detailed within their respective privacy statements.

  • Affiliates: We may share personal information with and among our parent company, subsidiaries, affiliates, or their successors or assigns.

  • Marketing, Analytics, and Advertising Partners: We may share personal information with third party marketing, analytics or advertising partners, including social media platforms and networks, for commercial purposes such as sending you marketing emails and advertisements.

  • Professional Advisors: We may share information with professional advisors, such as lawyers, bankers, auditors, and insurers, where necessary, in the course of the professional services that they render to us.

  • Government Entities: We share information with regulatory and government entities including government, administrative, law enforcement and regulatory agencies; tax authorities; corporate registries; and other public agencies or authorities if we have an obligation to do so in order to comply with any applicable law, regulation, legal process or other legal obligation. This includes cooperating with law enforcement when we need to do so, obtaining legal remedies or limiting our damages, and to enforce or protect our contracts, legal rights or the rights of others, including by responding to claims which may be asserted against us.

  • Corporate Transaction Recipients: We may share information with potential investors, purchasers, merger partners, and their advisors in the event we: (i) sell or transfer, or are considering selling or transferring, all or a portion of our business or assets; or (ii) are considering or engaging in any reorganization, conversion, merger, sale, joint venture, assignment, transfer or disposition of all or any portion of our ownership interest, business or operations.

  • With Your Consent or At Your Direction: We may share your information with third parties whenever you consent to or direct us to enable such sharing.

  • Other Reasons: We may share information for other reasons we may describe to you in advance.

  1. Links to Other Websites
    The Services may include links to other websites or applications whose privacy practices may differ from this Canopy Privacy Policy. If you submit your personal information to any of those websites or applications, your information will be subject to their respective privacy statements. We encourage you to carefully read the privacy policy of any website or app you visit.

  2. Security
    We have implemented reasonable technical, organizational, administrative and physical security controls designed to protect personal information.

    However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, we cannot guarantee its absolute security and encourage you to use caution when using websites, applications, or products, and sharing information, as well as protecting your own computer systems with effective antivirus and malware detection software.

  3. The Services are Not Intended for Children
    We do not knowingly collect or store any personal information from anyone under the age of 13. If we become aware that we have collected or stored personal information from an individual under age 13, we will permanently remove their personal information from our files. If you are a parent or guardian and believe we may have inadvertently collected personal information from your child, please notify us immediately by sending an email to privacy@canopy.security.

  4. Marketing Communications
    You can opt out of marketing or advertising emails or newsletters by using the "unsubscribe" link provided, or similar mechanism noted in communications you receive from us. You may also request to opt out of marketing or advertising emails by contacting us through one of the methods specified in the Contact Us section of this Privacy Policy. Once we process your request, we will cease using the information for such purposes at no charge to you. If you opt out of receiving marketing messages, you will continue to receive messages from us about your contractual relationship with Canopy, where permitted by law. We do not disclose your personal information with third parties for the third parties’ direct marketing purposes.

  5. Retention of your Information
    We will retain and use your personal information for only as long as is necessary for Canopy to undertake the specific processing activities for which it was obtained, and in accordance with our Data Retention Schedule.

    For employment applications, successful applicants will have their data retained in accordance with our Employee Privacy Statement for the duration of and following their employment with the Company. For unsuccessful applicants, personal data will be retained for a maximum period of 12 months following our last interaction with the applicant and will then be securely deleted.

    For users of the Services, we will retain your personal information for as long as we need it to provide you with the Products or Services to meet our contractual obligations, or as long as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

    Users of our Services should be aware that de-identified or anonymized versions of information may be retained indefinitely for Canopy’s own business purposes, including product development purposes, such as machine learning of the artificial intelligence providing enhanced security. 
  6. Cookies, Analytics, and Other Tracking Technologies
    We use carefully selected online tools to help us better serve and recognize you when you visit or use the Services. We receive and store certain types of information when you use the Services.

    When you access the Services, we (and companies we work with) may place small data files on your computer or other device. These data files may be web beacons, cookies, clear gifs, pixel tags, e-tags, flash cookies, log files, or other local storage provided by your browser or associated applications. These tracking technologies (which are often referred to collectively as cookies) allow us to understand how users navigate to and around the Services, view different pages, access content and request the Services. We may use them, for example, to keep track of your preferences and profile information and collect general usage and volume statistical information. If you want to remove or block cookies, you will be able to update your browser settings. You can also find instructions on how to manage cookies on different types of web browsers at https://www.allaboutcookies.org.

    Some browsers have a "do not track" feature. It lets you tell websites you visit that you do not want them to track your online activity. These features are not yet uniform across browsers. The Services are not currently set up to respond to these signals. For more information on “do not track signals”, please visit https://allaboutdnt.com/.

We allow others to provide analytics services and serve advertisements on our behalf across the Internet and in mobile applications. These entities may use cookies, web beacons, device identifiers, and other technologies to collect information about your use of the Services and other websites and applications, including your IP address, web browser, mobile network information, pages viewed, time spent on pages or in mobile apps, links clicked and conversion information. We use this information to, among other things, analyze and track data, determine the popularity of certain content, deliver advertising and content targeted to your interests, and better understand your online activity.

We use analytics services provided by Google Analytics.  If you would like more information on how Google uses data when you visit or use the Services, please visit www.google.com/policies/privacy/partners.  If you would like to opt-out, Google provides a an opt-out tool which is available at https://tools.google.com/dlpage/gaoptout.

  1. International Transfer of Your Personal Information
    The Services are intended to be supplied from and used within the United States. If you are using or accessing the Services from outside the United States, please be aware that personal information we obtain about you will be processed in the United States or in other specified jurisdictions.

    By using the Services, you acknowledge your personal information may be transferred to and processed in jurisdictions outside your own, including the United States, as described within this Privacy Policy. Please be aware that the data protection laws and regulations that apply to your personal information transferred to the United States or other countries may be different from the laws in your country of residence. The United States may not afford the same level of protection as laws in your own country. 
  2. Privacy Rights
    You may have certain rights relating to your personal information, depending on your location and subject to your local applicable privacy laws. These rights may include your right to:

  • know what personal information is being collected by Canopy, and for what purposes.  
  • know what personal information is being shared by Canopy, for what purpose, and details of the recipients of the shared information.
  • have access to your personal information.
  • have your personal information rectified, corrected, or updated.
  • have your personal information deleted, in certain circumstances, including from any third parties where your personal information has been shared or disclosed by Canopy.
  • opt out of the sale or sharing your personal information, in certain circumstances. 
  • object to the processing of your personal information, in certain circumstances.
  • not be subject to any automated decision making and profiling which has used your personal information. 

If you would like to access, review, update, correct, and delete any personal information which Canopy may hold about you, or exercise any other privacy rights available to you, you should send an email to our Data Protection Officer at privacy@canopy.security. If we are unable to comply with your request due to an exception or limitation, or need more time to complete your request, we will explain this to you. period.

Canopy does not discriminate against you for exercising any of your privacy rights.

  2. Changes to the Privacy Notice From time to time we may make changes to our privacy policies, which changes shall be effective upon posting.  We will notify you of any material changes to our Privacy Policy if and as required by law. We will also post an updated copy on the website where this appears, so please check our website periodically for updates.
